Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the inclusifyapp.com website and the Inclusify app accessibility widget (the "Service") operated by IDT Media SIA ("us", "we", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Subscription and Services

1.1 License Grant

Subject to your compliance with these Terms, IDT Media SIA grants you a non-exclusive, non-transferable, revocable license to embed the Inclusify app script on the domains specified in your subscription plan.

1.2 Account Responsibility

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.

2. Fees and Payment

  • Billing: The Service is billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (monthly or annually).
  • Price Changes: IDT Media SIA may modify the Subscription fees at any time. Any change will become effective at the end of the current billing cycle.
  • Refunds: Except when required by law, paid Subscription fees are non-refundable.

3. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of IDT Media SIA and its licensors. Our trademarks and trade dress may not be used without prior written consent.

4. Accessibility Compliance Disclaimer

  • No Guarantee of Legal Immunity: While Inclusify app aligns with WCAG 2.1/2.2, ADA, and Section 508 standards, we do not guarantee that your website will be 100% compliant or immune to legal action.
  • Responsibility for Content: You remain solely responsible for the underlying code and content of your website. Inclusify app is an enhancement tool and does not fix fundamental architectural flaws.

5. Limitation of Liability

In no event shall IDT Media SIA be liable for any indirect, incidental, special, or consequential damages resulting from your access to or inability to use the Service.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Latvia, without regard to its conflict of law provisions.

8. Changes

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
